Terms of service.

1. General Terms

  • 1.1 This agreement explains our obligations to you and explains your obligations to us for various services offered by PathToWEB (PTW). When you use your account or permit someone else to use it to purchase or otherwise acquire access to additional PTW service(s) or products or to cancel your PTW services (even if we were not notified of such authorization), this agreement covers such service or actions.
  • 1.2 PathToWEB undertakes to provide the best service available for each customer in accordance with signed package.
  • 1.3 PathToWEB reserves the right to cancel service to any customer that violates any policy including the Terms of Service, PathToWEB will be the sole arbiter on what constitutes a violation of these policies.
  • 1.4 All services provided by PathToWEB, may be used for lawful purposes only.
  • 1.5 By signing up for any service you agree to follow the terms of service.

2. Privacy Statement.

  • 2.1 Privacy Statement describes the private information we received from you, what we do with the information, and our information security practices.
  • 2.2 This notice applies to all information collected or submitted on the PathToWEB website. On some pages, you can order products, make requests, and register to receive materials. We may ask you for personal information such as name and or surname, company name, address, phone number, email address and or credit card information. In order to provide technical support we may ask for technical info including access data to product/server/service.
  • 2.3 All order forms on PathToWEB utilize a Secure Socket Layer (SSL) or Secure Electronic Transaction (SET) protocol to provide "secure sessions" for our visitors. Through the "secure session," information that you input into a PathToWEB order form will be sent and will arrive privately and unaltered at a PathToWEB server. This security prohibits other companies and Web users from being able to access your information.
  • 2.4 PathToWEB will not provide any private information to any person other than a law enforcement or regulatory agency at their request.

3. Usage Policy

  • 3.1 Transmission, storage, or presentation of any information, data or material in violation of Estonia or local government law is prohibited. You agree to maintain your resource in full compliance with the terms listed below.
  • 3.2 By using any services, provided by PathToWEB you agree:
    • - not to violate the laws, regulations, ordinances or other such requirements of any applicable Estonia or local government.
    • - not to transmit any unsolicited commercial or bulk email, not to be engaged in any activity known or considered to be spamming or Mail Bombing.
    • - not to make any inappropriate communication to any Newsgroup, Mailing List, Chat Facility, or another Internet Forum.
    • - not to make, attempt or allow any unauthorized access to PathToWEB website, servers, your own hosting account or the account of any other customers of PathToWEB.
    • - not to allow any remote code execution of malicious software through the hosting account provided by PathToWEB.
    • - not to cause denial of service attacks, port scans or other endangering and invasive procedures against PathToWEB servers and facilities or the servers and facilities of other network hosts or Internet users.
    • - not to forge the signature or other identifying mark or code of any other person or engage in any activity to attempt to deceive other persons regarding the true identity of the User.
    • - not to use PathToWEB services to host any website, other content, links or advertisements of websites that: infringe any copyright, trademark, patent, trade secret, or other proprietary rights of any third party information; are connected with child pornography; profess hatred for particular social, ethnical, religious or other group; contain viruses, Trojan horses, worms, time bombs, corrupted files, or any other similar software or programs that may damage the operation of a computer or a person's property; contain warez; contain any kind of proxy server or other traffic relaying programs; promote money making schemes, multi-level marketing or similar activities; contain torrent trackers, torrent Portals or similar software; violent or encouraging violence.
    • - not to upload unacceptable material which include: IRC bots, proxy scripts, warez, image, filedump, mirror, or banner-ad services, topsites, commercial audio streaming, Escrow, High-Yield Interest Programs (HYIP) or related sites, investment sites, sale of any controlled substances without providing proof of appropriate permit(s) in advance, AutoSurf sites, lottery sites, muds / rpg's, hate sites, hacking focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts.
    • - not to engage in or to instigate actions that cause harm to PathToWEB or other Customers. Such actions include, but are not limited to, actions resulting in blacklisting any of our IPs by the any online spam database, actions resulting in DDOS attacks for any servers, etc.
  • 3.3 PathToWEB reserves the right to refuse service to anyone upon our discretion. Any material that in PathToWEB judgment, is either obscene or threatening is strictly prohibited and will be removed from PathToWEB servers immediately with or without prior notice and may lead to possible warning, suspension or immediate account termination with no refund.
  • 3.4 You agree that we have the sole right to decide what constitutes a violation of the acceptable policy use described above as well as what is the appropriate severity of any corrective action to be applied. In the event that a violation of our TOS is found, PathToWEB will take corrective action upon our own discretion and will notify you. PathToWEB decision in such case is binding and final, and cannot be a subject of a further change. PathToWEB cannot and shall not be liable for any loss or damage arising from our measures against actions causing harm to PathToWEB or any other third party.
  • 3.5 We have the right to terminate each and any account that has been suspended for any reason for more than 7 calendar days after the suspension date, unless you has taken corrective measures to remove the initial suspension threat or violation. Any backup copies of the hosting account will be permanently deleted upon termination and no refund will be due. PathToWEB will not be liable for any loss or damages in such cases.
  • 3.6 If you do not qualify for offered package, your account may be required to be upgraded, or PathToWEB may move your resource to a different server, to reduce the load on the server you are currently residing. PathToWEB will be the sole arbiter as to what constitutes a violation of usage limitations. At any time PathToWEB may move your resource to a different server and change assigned to your resource IPs, to reduce the load on the server you are currently residing.

4. Software Usage Agreement

  • 4.1 Commercial Advertising - Email and Anti-SPAM Policy.
    • - Spamming, or the sending of unsolicited email, from a PathToWEB server or using an email address that is maintained on a PathToWEB machine is STRICTLY prohibited. For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them.
    • - Sending spam and unsolicited messages to weblogs or automatically publish multiple unrelated comments or promotions of commercial services to weblog sites is STRICTLY prohibited.
    • - Spamming using third-party proxy, aggregation of proxy lists, or proxy mailing software installation is STRICTLY prohibited.
    • - Configuring a mail server to accept and process third-party emails for sending with no user identification and/or authentication is STRICTLY prohibited.
    • - Hosting any web pages or providing any services that support spam is STRICTLY prohibited.
  • 4.2 Chat Rooms: PathToWEB does allow clients to install chat rooms. However, these tend to be large system hogs and may fall into the usage limitations clause.
  • 4.3 Background Processes/Programs: PathToWEB may allow programs to run continually in the background when this doesn't cause overloading of the master server you are currently residing.
  • 4.4 IRC: PathToWEB currently does not allow IRC or IRC bots to be operated on our servers.
  • 4.5 Cron Tasks: PathToWEB does allow Cron Jobs to be conducted on our servers.
  • 4.6 Multiple Connections: Multiple sessions are allowed to any offered product/server/service but PathToWEB may set restrictions if that provokes the resources limitations overloading or if character of networking usage looks like as DDoS/Packet Storm/Flood.
  • 4.7 Non-Exclusive Licenses: If you have licensed software from PathToWEB, PTW grants you a limited, non-exclusive, nontransferable and non-assignable license to use the software for such purposes as are ordinary and customary. You agree to not alter or modify the software. You further agree not to reverse engineer, decompile or otherwise attempt to uncover the source code. Any such software and services are provided to you "as is" without warranty of any kind either express or implied, including but not limited to the implied warranties or conditions of merchantability or fitness for a particular purpose.
  • 4.8 Third-Party Software: PathToWEB provides some third party software to you for easier account management including, but is not limited to Direct Admin, ISP Manager, WHM/CPanel, etc. Such software is provided on an "as is" as available basis. We do not guarantee that any specific results can be obtained by using such software. PathToWEB does not take responsibility for any faults in such software functioning.
  • 4.9 Third-Party Content: If you elect to sell or resell advertising or web space to a third party then you will be responsible for the contents of that advertising and the actions of that third party. PathToWEB has the absolute right to reject any advertising or other third party content that is illegal, offensive or otherwise in breach of the then current PathToWEB policy or agreement. Such content may result in the suspension or in the immediate termination of your account. You are responsible for monitoring all domain transfers, renewal and orders. In the event that an error occurs the account holder must notify PathToWEB immediately of the error. In no event shall PathToWEB be liable to the Account Holder for any damages resulting from or related to any failure.

5. Backuping, Storage and Security

  • 5.1 At all times, you shall bear full risk of loss and damage to your server and all of your server content.
  • 5.2 You are entirely responsible for maintaining the confidentiality of your password and account information.
  • 5.3 You acknowledge and agree that you are solely responsible for all acts, omissions and use under and charges incurred with your account or password or in connection with the server or any of your server content displayed, linked, transmitted through or stored on the server.
  • 5.4 You shall be solely responsible for undertaking measures to:
    • - prevent any loss or damage to your server content;
    • - maintain independent archival and backup copies of your server content;
    • - ensure the security, confidentiality and integrity of your server content transmitted through or stored on PathToWEB servers;
    • - ensure the confidentiality of your password;
  • 5.5 PathToWEB servers are not an archive and PathToWEB shall have no liability to you or any other person for loss, damage or destruction of any of your content.
  • 5.6 The services offered by PathToWEB are not intended to provide a PCI (Payment Card Industry) compliant environment and therefore should not be utilized as such without further compliance activity.
  • 5.7 PathToWEB shall have no liability to you or any other person for your use of PathToWEB products and/or services in violation of these terms.
  • 5.8 PathToWEB makes daily backup of VPS'es for fail-over repairing operations ONLY but we do not provide any guarantees on your data safety and/or integrity and this shall not be used to prosecute PathToWEB if your data will be completely lost at any times. You shall understand that for doing corresponding backup procedures you need to use external data storage to keep backup healthy even if your server's datastore will be completely broken.
  • 5.9 PathToWEB shall not be liable for any losses or damages resulting from the use or mis-use of PTW equipment or services by any party.

6. Suspension/Termination Policy

  • 6.1 If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation.
  • 6.2 PathToWEB reserves the right to remove any account without prior notice.
  • 6.3 If PathToWEB deactivates your account(s) for violating policy, your will forfeit your rights to a refund. No refunds for advance payments, on de-activated accounts are acceptable.
  • 6.4 Normal policy is a warning first, and account de-activation the second offense. Serious offenses may cause immediate de-activation.
